1. About these terms

These terms and conditions govern your use of the LeadXCultures website (leadxcultures.com) and the coaching and training services provided by LeadXCultures, operated by Chaz Pugliese. By accessing this website or engaging our services, you agree to these terms.

We may update these terms from time to time. The current version is always available on this page. Continued use of our services following any changes constitutes acceptance of the updated terms.

2. Our services

LeadXCultures provides communication coaching, intercultural communication coaching, executive coaching, and team communication training. Services are delivered online and, where agreed, in person.

All services are described on our website for general information only. The precise scope, format, duration, and objectives of any engagement are agreed in writing between us before work begins.

3. Consultations

An initial complimentary consultation (up to 30 minutes) is offered to explore whether there is a fit between your needs and our services. This consultation is not a coaching session and does not create a contractual obligation on either party.

We reserve the right to decline an engagement where we determine that our services are not suited to your needs.

4. Fees and payment

Fees for coaching and training services are agreed individually and confirmed in writing prior to commencement. Fees are invoiced in advance or as agreed in your engagement letter.

Payment is due within 14 days of invoice unless otherwise agreed in writing. Late payment may result in suspension of sessions until the outstanding balance is settled. We reserve the right to charge interest on overdue invoices at the statutory rate applicable in the relevant jurisdiction.

All fees are exclusive of any applicable taxes (such as VAT) unless stated otherwise. Where applicable, tax will be added to invoices at the prevailing rate.

5. Cancellation and rescheduling

We understand that schedules change. The following policy applies to individual coaching sessions:

• Cancellations or rescheduling requests made at least 48 hours before a session incur no charge.
• Cancellations made with less than 48 hours' notice may be charged at the full session rate, except in cases of genuine emergency.
• We will give you as much notice as possible if we need to reschedule a session and will offer an alternative date at no additional cost.

For group programmes and team engagements, specific cancellation terms will be set out in the engagement letter.

6. Confidentiality

We treat all information shared by clients during coaching sessions as strictly confidential. We will not disclose the content of sessions to third parties without your explicit consent, except where required by law or where we have a duty to prevent serious harm.

Where coaching is commissioned by an organisation on behalf of an individual, the specific content of sessions remains confidential between coach and coachee. We may provide general progress updates to the commissioning organisation where this has been agreed in advance and the coachee has given informed consent.

7. Intellectual property

All content on this website — including text, design, graphics, tools, and methodologies — is the intellectual property of LeadXCultures unless otherwise stated. You may not reproduce, distribute, or use any content without our prior written permission.

Materials provided to you during a coaching engagement are for your personal or internal organisational use only and may not be shared, resold, or published without our written consent.

8. Limitation of liability

Coaching is a collaborative process. Results depend on your active engagement and the effort you apply. We do not guarantee specific outcomes, career outcomes, business results, or performance improvements.

To the fullest extent permitted by law, our liability for any claim arising from our services is limited to the total fees paid by you for the specific engagement giving rise to the claim. We are not liable for indirect, consequential, or incidental losses.

Nothing in these terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Website use

This website is provided for information purposes. We make reasonable efforts to ensure the information is accurate and up to date but make no warranties as to its completeness or fitness for any particular purpose.

We are not responsible for the content of any third-party websites linked from this site. Links are provided for convenience and do not constitute endorsement.

You may not use this website in any way that is unlawful, harmful, or disruptive to other users or to the operation of the site.

10. Governing law

These terms are governed by and construed in accordance with French law. Any disputes arising from these terms or our services that cannot be resolved by agreement will be subject to the exclusive jurisdiction of the courts of France, without prejudice to any mandatory consumer rights you may have under your local law.
